On April 25, 2016 at around 3:00 p.m., Plaintiff Jose Guerra was driving his work vehicle, a 1990 Peterbilt 337 truck, southbound on McClintock Drive approaching Broadway Road in Mesa, Arizona.
Heading in the same direction, in a parallel lane, a City of Tempe garbage truck controlled by a City of Tempe employee drove next to Jose Guerra's vehicle.
The City employee had failed to retract the hydraulic loading arms of the garbage truck before proceeding onto the roadway. The driver then moved out of his lane and sideswiped Plaintiff Jose Guerra's work truck, striking it with the garbage truck's loading arms. The driver of the garbage truck was cited for violating ARS 28-729.1, failure to keep in proper lane.
Plaintiff Jose Guerra claimed he was injured as a result of the collision.
The City of Tempe admitted fault in the collision but denied that Plaintiff Jose Guerra was injured because he did not immediately seek medical treatment nor complain of any injury while at the scene of the collision.
The jury awarded Jose Guerra $152,355.05 in damages against the City of Tempe.
